Upon successful completion of this course, the user should be able to:

• differentiate rental activities that may constitute a trade or business from passive investment activities by applying relevant facts-and-circumstances and material-participation considerations;

• classify real estate as residential or nonresidential property and determine the potential depreciation treatment of buildings and qualifying post-acquisition improvements; and

• evaluate how short-term rental rules, Section 280A, self-employment tax, real estate professional status, Section 199A, and Section 1031 may affect the federal tax treatment of a real estate activity.
